Sales Terms & Conditions

Guarantee

All plants are guaranteed for five years. Any failures will normally be replaced free of charge.

We cannot be held responsible for losses due to abnormal weather conditions or other factors beyond our control.

Orders

All varieties in this list are offered subject to being unsold at the time we receive your order. All descriptions, colours and heights described in our catalogues and website are approximate.

Prices

Stated are ex-nursery. We are obliged to reserve the right to alter our prices at any time.

Value Added Tax

All prices are subject to VAT. at the prevailing rate.

Payment terms and Credit Charge

50% payment with confirmation of order

50% strictly net 30 days from delivery.

A surcharge of 10% will be added to overdue accounts

Note for Landscape Architects & Professional Advisers

When requested by the architect to invoice a client direct the client will be invoiced at our retail rate.

Title of Goods

The risk in the goods passes to the Buyer upon delivery but title to the goods shall remain vested in the

Seller until full payment has been received.

Cancellations

Should an order fulfilled or otherwise be cancelled by a customer we reserve the right to demand 75% of the order value (not including the VAT. element) as liquidated damages without having to prove the action.

Complaints

We take considerable care in the preparation and the delivery of our plants. In the unlikely event of there being any cause for complaint, we must be notified in writing within seven days of receipt of the goods as we cannot be held responsible for any subsequent losses.

Contract

The placing of any order implies acceptance of the above terms.
